Child Guardians?

A guardian is the person responsible for a child’s (or other dependent or incapacitated person’s) physical care, education, health and welfare; as well as for making decisions about the child’s faith-related matters.

In the normal scheme of things, if you are married and have a child you and your spouse are the primary legal guardians of your minor children, including any children that you may have adopted together. If you pass away, then your surviving spouse becomes the sole guardian of these children. However, should your surviving spouse also pass away, and neither of you have made any provisions for the appointment of a guardian, then the children could become the responsibility of the court. Where this happens, there is a real risk that your children will end up being cared for by people that you would never have wished to raise them.

If you have children, it is therefore vital to plan ahead and ensure that they will be properly cared for in the event that neither you nor your spouse are around to do so. In this respect, you should give careful thought and consideration to naming a guardian and an alternate guardian in your will to take care of your children following your passing.
